Welcome to My Special Needs ('App'). The App is operated by MySpecialNeeds ('we,' 'our,' or 'us'). These Terms and Conditions ('Terms') govern your access to and use of the platform as a Therapy Provider, including all professional tools, management dashboards, and related services available through our web and mobile applications (collectively, the 'Services').
By registering or using My Special Needs as a Therapy Provider, you agree to these Terms, our Privacy Policy (https://myspecialneeds.com/privacy/therapy_provider), and all applicable laws and regulations. If you do not agree, you must not access or use the Services.
You must be a verified business entity, therapy clinic, or organization legally authorized to provide therapy or allied health services in your jurisdiction.
You represent and warrant that all licenses, registrations, and qualifications of your organization and associated practitioners are valid and compliant with applicable professional standards and regulations.
You are responsible for ensuring that all therapists, employees, or contractors using your Provider account follow these Terms and maintain ethical and professional standards of care.
Each Therapy Provider must create an official account to access the platform’s professional features.
During registration, you agree to provide accurate, complete, and up-to-date information about your organization, including verification documents, contact information, and registered practitioners.
You are responsible for managing authorized users under your organization’s account and ensuring that all login credentials are kept secure and confidential.
If unauthorized access or misuse of your Provider account occurs, you must notify MySpecialNeeds immediately.
You may add or invite authorized users (e.g., therapists, admins, staff) under your Provider account. Each authorized user must agree to comply with these Terms.
You are fully responsible for all actions taken by authorized users under your account, including data handling, communications, and service delivery.
MySpecialNeeds reserves the right to verify or suspend access for any user connected to your Provider account who violates these Terms or applicable laws.
As a Therapy Provider, you agree to maintain professional and ethical conduct consistent with your licensing body and applicable healthcare laws.
You must ensure that your team provides accurate, lawful, and respectful communication through the platform.
You agree not to misrepresent your services, outcomes, or qualifications in any way.
You are responsible for maintaining the confidentiality of all client information collected, stored, or transmitted through the platform.
All data shared by clients or therapists within your organization must be handled in accordance with the Australian Privacy Principles (APPs), GDPR, and other applicable data protection regulations.
You must not export or disclose client information outside of the platform except when legally required or with explicit consent from the client.
In case of any data breach within your organization, you must immediately report it to MySpecialNeeds and take all necessary mitigation steps.
Certain Provider features, such as multi-user management, enhanced visibility, or integrated CRM tools, may require a paid subscription.
Subscription payments are managed through secure third-party processors such as Stripe. You agree to provide accurate billing information and maintain valid payment methods.
All fees are non-refundable unless otherwise stated in writing by MySpecialNeeds.
Failure to make payments may result in temporary suspension or termination of your Provider account.
MySpecialNeeds is a digital platform facilitating communication and data management between Providers, Therapists, and Clients. We are not a healthcare provider and do not employ or supervise Therapists or Provider staff.
You are solely responsible for the conduct and quality of care provided by your staff or contractors using the App.
All client-therapist interactions, bookings, and session outcomes are governed by your internal policies and professional obligations, not by MySpecialNeeds.
Our Privacy Policy outlines how we collect and manage data from Providers, Therapists, and Clients. You agree to comply with our Privacy Policy and all applicable privacy regulations.
You are responsible for ensuring that all authorized users within your organization understand and adhere to these privacy obligations.
You must implement reasonable technical and administrative measures to prevent unauthorized access to sensitive information.
All intellectual property related to the App, including its software, features, design, and branding, is the exclusive property of MySpecialNeeds or its licensors.
Providers retain ownership of their uploaded content, such as clinic details, service descriptions, or training materials, but grant MySpecialNeeds a non-exclusive license to host and display such content for platform functionality.
You may not modify, reproduce, distribute, or create derivative works from any part of the App without prior written consent from MySpecialNeeds.
As a Provider, you agree not to:
• Use the platform for fraudulent, unethical, or illegal activities.
• Upload false, misleading, or defamatory content about clients or other providers.
• Share or post identifiable client data without consent.
• Reverse-engineer or tamper with the platform’s security mechanisms.
• Offer or promote non-therapeutic or unrelated services using the App.
The App may integrate with third-party systems (e.g., CRMs, plan managers, telehealth platforms). Use of these integrations is optional and governed by the respective third party’s terms and policies.
MySpecialNeeds is not responsible for any failures, breaches, or issues caused by third-party services connected to your account.
We reserve the right to verify your credentials, professional licenses, and compliance with relevant laws before or after account approval.
MySpecialNeeds may request documentation or additional verification as part of ongoing quality assurance processes.
Failure to provide accurate or valid information may result in suspension or removal from the platform.
We may suspend or terminate your Provider account immediately if we reasonably believe you or your organization have violated these Terms, failed to maintain compliance, or engaged in conduct harmful to users or the platform.
Upon termination, access to all organization data and related services will be restricted or permanently deleted as permitted by law.
You may request voluntary account closure by contacting support@myspecialneeds.com.
You agree to indemnify and hold harmless MySpecialNeeds, its employees, directors, agents, and affiliates from any claims, losses, damages, or liabilities arising out of:
• Your use of the Services;
• Your organization’s breach of these Terms;
• Any negligence, misconduct, or professional error by your staff or associated practitioners.
THE SERVICES ARE PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS WITHOUT WARRANTIES OF ANY KIND.
MYSPECIALNEEDS DOES NOT GUARANTEE THAT THE PLATFORM WILL BE ERROR-FREE OR UNINTERRUPTED OR THAT CLIENT COMMUNICATIONS WILL ALWAYS BE DELIVERED SUCCESSFULLY.
YOU ACKNOWLEDGE THAT THE PLATFORM IS A DIGITAL TOOL FOR FACILITATION AND NOT A SUBSTITUTE FOR PROFESSIONAL MANAGEMENT, COMPLIANCE, OR CLINICAL OVERSIGHT.
IN NO EVENT SHALL MYSPECIALNEEDS OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF THE PLATFORM OR SERVICES.
MYSPECIALNEEDS IS NOT LIABLE FOR ERRORS IN BILLING, PROFESSIONAL MISCONDUCT, OR DISPUTES BETWEEN YOUR ORGANIZATION, THERAPISTS, OR CLIENTS.
These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia.
You agree that any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts located in Victoria, Australia.
We reserve the right to update or modify these Terms at any time to reflect changes in operations, features, or legal requirements.
You will be notified of significant updates via email or in-app notice. Continued use of the Services after such notice constitutes acceptance of the updated Terms.
These Terms, along with the Privacy Policy, constitute the entire agreement between you and MySpecialNeeds.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full effect.
No failure by MySpecialNeeds to enforce any right or provision shall constitute a waiver of such right or provision.
