Introduction

Welcome to My Special Needs ('App'). The App is operated by MySpecialNeeds ('we,' 'our,' or 'us'). These Terms and Conditions ('Terms') govern your access to and use of the platform as a Therapist, including all features, professional tools, and related services made available through our web or mobile applications (collectively, the 'Services').

By registering as a Therapist, accessing, or using any part of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy available at https://myspecialneeds.com/privacy/therapist. If you do not agree, you must not access or use the Services.

Eligibility and Professional Responsibility

You must be a qualified therapist, healthcare provider, or licensed professional authorized to provide therapy or related support services in your jurisdiction.

By using the Services, you represent and warrant that all professional credentials, certifications, and registrations you provide (including AHPRA or NDIS provider numbers, if applicable) are valid and accurate.

You are solely responsible for complying with all applicable laws, licensing requirements, and professional standards in the delivery of care or therapy to clients via the App.

Account Registration and Security

To use the Services, you must create a Therapist Account and provide accurate, complete, and up-to-date information during registration.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You must promptly update any information that becomes inaccurate or outdated, including contact details, professional credentials, or business affiliations.

We reserve the right to suspend or terminate accounts containing false, misleading, or unverifiable information.

Professional Conduct and Compliance

You agree to use the Services only for lawful, ethical, and professional purposes related to therapy or care delivery.

You must ensure that all client interactions, documentation, and communications made through the platform comply with relevant privacy, healthcare, and record-keeping regulations, including the Australian Privacy Principles (APPs) and any regional health legislation.

You agree not to provide therapy, advice, or recommendations outside your professional scope or qualifications.

Client Data and Confidentiality

As a Therapist, you may have access to sensitive personal information about clients. You agree to handle such information strictly in accordance with privacy and confidentiality obligations.

You must not export, disclose, or share client information outside the App unless explicitly permitted by the client or required by law.

You are responsible for ensuring that all therapy notes, reports, and updates entered into the App are accurate, respectful, and free from unauthorized identifiers.

In the event of a data breach involving client information within your control, you must immediately notify MySpecialNeeds and take reasonable steps to mitigate any potential harm.

Professional Listings and Visibility

By creating a profile, you authorize MySpecialNeeds to display your professional information — including your name, credentials, specialties, and practice location — within the App so that clients may discover and contact you.

You are responsible for the accuracy of your public information and for maintaining up-to-date availability and session details.

MySpecialNeeds reserves the right to verify, review, or remove any Therapist profile that is incomplete, misleading, or violates our standards.

Payments and Subscriptions

Certain professional tools or listing enhancements may require paid subscriptions or transaction fees.

Payment processing is handled through trusted third-party providers such as Stripe. You agree to comply with their terms and ensure accurate banking and tax information is provided.

MySpecialNeeds is not responsible for payment disputes arising between Therapists and clients unless directly related to technical billing issues within the platform.

Relationship with Clients

You acknowledge that MySpecialNeeds is a digital platform facilitating communication between Therapists and clients. We are not a healthcare provider and do not employ or supervise any Therapist.

All therapy sessions, advice, and care provided through the App are the sole responsibility of the Therapist. MySpecialNeeds does not verify the clinical content, recommendations, or outcomes of therapy sessions.

You must obtain informed consent from each client before commencing any therapy or data recording activities via the App.

Data Privacy and Security

Our Privacy Policy outlines how we collect, store, and process your personal and client data. You agree to comply with this policy and all applicable data protection regulations.

You are responsible for maintaining secure storage and handling of client-related information and ensuring that no unauthorized person gains access to your account or records.

Intellectual Property Rights

All content, branding, designs, and software within the App remain the exclusive property of MySpecialNeeds or its licensors.

You retain ownership of your original content (such as therapy notes or resources) but grant MySpecialNeeds a limited, non-exclusive, royalty-free license to host and display it for service delivery purposes.

You may not copy, modify, or distribute any part of the App’s code, design, or proprietary materials without our prior written consent.

Prohibited Uses

You must not use the Services to:

• Provide medical or therapeutic services without proper credentials or licenses.

• Upload or transmit content that is false, defamatory, discriminatory, or violates any person’s rights.

• Share identifiable client information publicly or without authorization.

• Use the App for advertising unrelated services, spam, or any non-therapeutic purpose.

• Interfere with or attempt to compromise the App’s security or performance.

Third-Party Services and Integrations

The App may integrate with external tools such as CRMs, telehealth platforms, or payment gateways. These services are governed by their own terms and privacy policies.

MySpecialNeeds does not endorse or assume responsibility for any third-party tools, nor for their reliability, security, or performance.

You are responsible for reviewing and complying with third-party service terms before use.

Termination and Account Suspension

We reserve the right to suspend or terminate your Therapist account at any time if we reasonably believe you have violated these Terms, engaged in misconduct, or provided inaccurate information.

Upon termination, access to your account and all related data may be restricted or deleted as permitted by law.

You may close your account at any time by contacting support@myspecialneeds.com.

Indemnification

You agree to indemnify, defend, and hold harmless MySpecialNeeds, its officers, employees, agents, and affiliates from any claims, losses, damages, or expenses arising from:

• Your breach of these Terms;

• Your violation of applicable laws or professional standards;

• Any advice, therapy, or services provided to clients through the App.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

WE DO NOT GUARANTEE THAT THE PLATFORM WILL OPERATE WITHOUT INTERRUPTION OR ERRORS OR THAT CLIENT COMMUNICATIONS WILL BE SECURE OR ERROR-FREE.

YOU ACKNOWLEDGE THAT THE APP IS A TECHNOLOGY PLATFORM AND NOT A SUBSTITUTE FOR PROFESSIONAL JUDGMENT OR REGULATORY COMPLIANCE.

Limitation of Liability

IN NO EVENT SHALL MYSPECIALNEEDS OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR ANY CLIENT INTERACTION THEREIN.

MYSPECIALNEEDS IS NOT LIABLE FOR THERAPY OUTCOMES, CLINICAL DECISIONS, OR PROFESSIONAL CONDUCT OF THERAPISTS REGISTERED ON THE PLATFORM.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Victoria, Australia.

You agree that any disputes arising from these Terms or your use of the Services shall be resolved exclusively in the courts of Victoria, Australia.

Changes to These Terms

We may revise these Terms periodically to reflect changes in our Services, regulatory requirements, or operational practices.

We will notify you of material updates via email or in-app notification. Continued use of the Services after such updates constitutes your acceptance of the revised Terms.

General Provisions

These Terms, together with the Privacy Policy and any additional guidelines posted on the App, constitute the entire agreement between you and MySpecialNeeds.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

No waiver of any term shall be deemed a continuing waiver or a waiver of any other term.
