Welcome to My Special Needs ('App'). The App is operated by MySpecialNeeds ('we,' 'our,' or 'us'). These Terms and Conditions ('Terms') govern your use of our mobile application, website, and related services (collectively, the 'Services') as an Individual user.
By creating an account or using the Services, you agree to these Terms and our Privacy Policy available at https://myspecialneeds.com/privacy/individual. If you do not agree, please discontinue using the App and Services.

The App provides tools to help you connect with therapists, track therapy progress, set personal goals, and manage your care journey.
You agree to use the App for lawful, personal, and non-commercial purposes only.
You must not misuse the App, upload harmful content, impersonate others, or interfere with other users' experiences.
The App, including its AI chatbot, informational content, and progress-tracking features, is designed to assist in therapy management but does not replace professional medical advice, diagnosis, or treatment.
Always consult with a qualified therapist, doctor, or healthcare professional before making any decisions regarding your health or therapy.
In the event of an emergency, you should contact your local emergency services immediately.
You may upload information such as therapy notes, goals, routines, or progress updates ('User Content').
You retain ownership of your User Content but grant MySpecialNeeds a non-exclusive license to store and process this information as required to provide Services.
You are solely responsible for the accuracy and legality of any content you upload, including ensuring you have consent before sharing any third-party information (e.g., about a carer or dependent).
We value your privacy. Our Privacy Policy explains how we collect, use, and protect your information.
You are responsible for maintaining the security of your personal data and ensuring your device access is protected.
By using the Services, you consent to the collection and processing of data in accordance with our Privacy Policy.
Some App features may require a paid subscription or one-time payment.
Payment processing is handled securely by third-party providers such as Stripe or PayPal.
You agree to provide valid payment details and understand that subscription fees are non-refundable except where required by law.
You agree not to:
• Use the Services for any illegal or harmful activities;
• Post or share misleading, abusive, or inappropriate content;
• Attempt to gain unauthorized access to the App or other users’ data;
• Reverse-engineer, modify, or interfere with the App’s functionality.
MySpecialNeeds serves as a technology platform connecting you with verified Therapists and Providers but does not employ or supervise them.
Any therapy or professional advice received through the App is provided by independent practitioners, not by MySpecialNeeds.
You are responsible for verifying the qualifications and suitability of any Therapist or Provider before engaging with them.
You can choose to share your information or therapy progress with authorized carers or therapists within the App.
Your shared data remains protected and is only accessible to parties you approve.
You may revoke access or delete shared data at any time through your account settings.
You may deactivate or delete your account at any time by contacting support@myspecialneeds.com.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent behavior, or misuse the App.
Upon termination, certain data may be retained as required by law.
All intellectual property rights in the App and its content, including trademarks, designs, and software, are owned by MySpecialNeeds or its licensors.
You may not copy, distribute, or modify any part of the App or use it for commercial purposes without prior written permission.
To the maximum extent permitted by law, MySpecialNeeds shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services.
We do not guarantee uninterrupted access, error-free operation, or that the App will meet your specific needs.
You agree to indemnify and hold harmless MySpecialNeeds, its employees, officers, and affiliates from any claims or damages arising from your misuse of the App, breach of these Terms, or violation of any law.
These Terms are governed by and construed in accordance with the laws of Victoria, Australia.
Any disputes arising from these Terms or the use of the Services shall be subject to the exclusive jurisdiction of the courts in Victoria, Australia.
We may update these Terms periodically to reflect legal, operational, or service changes.
You will be notified of material changes through email or in-app notice. Continued use of the App after such notice constitutes your acceptance of the updated Terms.
These Terms, along with our Privacy Policy, form the entire agreement between you and MySpecialNeeds.
If any provision is deemed invalid, the remaining provisions remain in effect.
Failure by MySpecialNeeds to enforce any right or provision shall not constitute a waiver of such right or provision.
