Welcome to the My Special Needs Business Registry ('Registry'). The Registry is operated by MySpecialNeeds ('we,' 'our,' or 'us'). These Terms and Conditions ('Terms') govern your access to and use of our business registration services, web portals, and related tools provided through registry.myspecialneeds.com (collectively, the 'Services').

By creating a business account, submitting a listing, or using any part of the Registry, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy https://registry.myspecialneeds.com/privacy. If you do not agree to these Terms, you must not access or use the Registry or its Services.

Eligibility and Authority

The Registry is intended for use by legitimate businesses, organizations, and service providers that offer disability-related products or services.

By registering on the Registry, you represent and warrant that: (a) you are at least 18 years of age, (b) you have the authority to enter into binding agreements on behalf of your business or organization, and (c) all information you submit is accurate, current, and truthful.

If you are registering a business on behalf of an organization, you confirm that you are an authorized representative and have the necessary rights to provide its information and agree to these Terms.

Account Registration and Responsibilities

To use the Registry, businesses must create an account by providing required registration details, including business name, contact information, and service details.

You agree to provide accurate, complete, and up-to-date information during registration and to promptly update your listing if any details change.

You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must immediately notify us of any unauthorized access or breach of security.

Business Listings and Public Information

The purpose of the Registry is to make disability-related services discoverable to individuals, carers, and community members.

When you create a business listing, you agree that the information you provide (such as business name, address, service descriptions, accessibility details, and contact information) may be displayed publicly on registry.myspecialneeds.com and other MySpecialNeeds platforms.

You are solely responsible for ensuring that any information you publish is lawful, accurate, and compliant with applicable regulations.

By submitting a business listing, you grant MySpecialNeeds a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your business information as part of the Services.

Verification and Review Process

To ensure authenticity and service quality, we may conduct verification checks on registered businesses. This may include validating licenses, certifications, or other credentials.

We reserve the right to approve, modify, or reject any business listing at our sole discretion if it does not meet our eligibility standards, verification requirements, or community guidelines.

Submission of false, misleading, or deceptive information may result in immediate removal of your listing and termination of your account.

Fees and Paid Services

Basic business registration on the Registry may be free. However, certain enhanced or premium listing features may require payment.

All paid services and subscriptions are processed through secure third-party payment processors such as Stripe or PayPal. We do not store your financial information directly.

You are responsible for all applicable fees, taxes, and charges incurred through your use of the Registry’s paid services.

Use of the Registry and Prohibited Conduct

You agree to use the Registry only for lawful purposes and in accordance with these Terms.

You may not use the Registry to:

• Post inaccurate, incomplete, or fraudulent information about your business or services;

• Impersonate another business or individual;

• Upload or distribute content that infringes on intellectual property rights or violates privacy laws;

• Post content that is discriminatory, obscene, defamatory, or otherwise inappropriate;

• Attempt to gain unauthorized access to the Registry, its systems, or user data;

• Scrape, harvest, or use automated systems to collect Registry data for any purpose.

Intellectual Property Rights

All content, designs, features, and functionality on the Registry platform are the exclusive property of MySpecialNeeds or its licensors and are protected by intellectual property laws.

You retain ownership of your business name, trademarks, and submitted materials but grant us a limited, non-exclusive, worldwide license to use your submitted content to operate and promote the Registry.

You may not copy, reproduce, or distribute any portion of the Registry’s interface, data, or design without our prior written consent.

Data Privacy and Security

Our handling of business and personal data is governed by our Privacy Policy, available at https://registry.myspecialneeds.com/privacy.

By using the Registry, you acknowledge and consent to the collection and use of your data as described in that policy.

You are responsible for ensuring that any data you share (including information about your staff or clients) complies with applicable data protection and privacy laws.

The Registry may include links, recommendations, or integrations with third-party tools, platforms, or websites.

We do not endorse, control, or assume responsibility for the accuracy, content, or privacy practices of any third-party services.

We aim to maintain accurate and reliable information on the Registry, but we do not independently verify all business details submitted.

MySpecialNeeds does not guarantee the accuracy, completeness, or authenticity of any listing or review.

Users are encouraged to verify information directly with the listed businesses before engaging their services.

Termination and Suspension

We reserve the right to suspend or terminate any account or listing at our discretion, without prior notice, if we believe you have violated these Terms, engaged in fraudulent activity, or provided false or misleading information.

Upon termination, your access to the Registry and all associated data may be disabled or deleted as permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless MySpecialNeeds, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising out of or related to your use of the Registry, your business listings, or your breach of these Terms.

Disclaimer of Warranties

THE REGISTRY AND ALL RELATED SERVICES ARE PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS.

MYSPECIALNEEDS MAKES NO WARRANTIES OR REPRESENTATIONS REGARDING THE ACCURACY, RELIABILITY, OR AVAILABILITY OF THE REGISTRY OR ANY LISTINGS DISPLAYED ON IT.

YOUR USE OF THE REGISTRY IS AT YOUR OWN RISK. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYSPECIALNEEDS AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE REGISTRY OR ANY BUSINESS LISTINGS.

THIS INCLUDES DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Dispute Resolution and Governing Law

These Terms are governed by and construed in accordance with the laws of Victoria, Australia.

You agree that any disputes or claims arising out of or relating to these Terms or your use of the Registry will be resolved exclusively in the courts located in Victoria, Australia.

Changes to These Terms

We may modify or update these Terms at any time to reflect changes in our practices or legal obligations.

If we make material changes, we will provide notice via email or a prominent announcement on the Registry. Continued use of the Registry after such changes constitutes your acceptance of the updated Terms.

General Provisions

These Terms, along with our Privacy Policy and any other agreements expressly referenced herein, constitute the entire agreement between you and MySpecialNeeds regarding your use of the Registry.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Failure by MySpecialNeeds to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
